An application has been submitted to confirm that a gym can lawfully operate at 103-119 Kilburn High Road in northwest London, with The Gym Group proposing to amalgamate first-floor units for use as a 24-hour fitness facility.
The application seeks a certificate of lawfulness for the proposed use, which falls under Class E and covers indoor sport, recreation and fitness.
A statement from the applicant said: "The historic use of the accommodation is as retail within Class E.
"This was further confirmed in the planning approval for the extension and refurbishment of the accommodation.
"The existing and proposed uses are within Class E and does not constitute development.
"There are no restrictions on use, amalgamation of units or hours of operation.
"Under the Planning Act, the amalgamation of commercial units and changes within the same Use Class do not constitute development.
"Therefore, the proposals do not constitute development and planning permission is not required."
According to planning documents, the space was previously used for retail purposes.
The site forms part of a mixed-use building on the busy high street and is surrounded by a variety of retail, commercial and residential properties.
Brent Council is considering the application, which was registered on Tuesday, December 16, 2025.
The applicant is not seeking planning permission, but a certificate confirming that permission is not required.
Brent Council’s planning department will decide whether to issue a lawful development certificate confirming that the proposed gym use is permitted under planning law.
